Terms and Conditions

These terms and conditions govern the sale, purchase, and use of the courses, certificates of completion, and services provided by the University of Alberta, Online Learning and Continuing Education, ("Institution") and may be updated from time to time. By accessing the Site, you agree to comply with and be bound by these terms. Please read this Agreement carefully before using the Site.

1. Definitions

  • "Institution" refers to the University of Alberta, the Institution.
  • “Site” refers to the courses and materials provided by the Institution purchased through Course Merchant and hosted on the Learning Management System (LMS), Brightspace by D2L, including any associated software, materials and content.
  • "Student" refers to any individual who accesses the LMS after purchasing courses from the Institution or has been registered through other means.
  • “Partner” refers to a program or entity other than the University of Alberta that lists and manages a course hosted on the Site.
  • “Awards” refers to the badge and/ or certificate of completion that students will receive upon completion of the course content. This is the terminology used within the Brightspace by D2L platform and does not refer to a financial scholarship.

2. Privacy

  • Please carefully review these Terms and Conditions and information regarding Privacy at the University of Alberta before proceeding.

3. Partners

 3.1 Institutional Partners

  • Additional service-level agreements, Memorandums of Understanding or Contracts may be in place with Institutional Partners. Institutional Partners are encouraged to consult their service agreement for more details as they will be bound by those terms, and outlined roles and responsibilities for use of the Site.

3.2 Students from Institutional Partners

  • The Institution may host courses, certificates of completion and other services for Institutional Partners. For courses offered by Institutional Partners, their policies, terms and conditions, and usage would apply. Students with questions or issues related to the administration of courses hosted by an Institutional Partner should contact the Institutional Partner they registered with.

4. Pricing and Payment

4.1 Pricing

  • The course prices are displayed on the University of Alberta’s Online Learning and Continuing Education website and other promotional materials.
  • The prices are stated in Canadian currency and exclude any fees and taxes unless otherwise specified. The Institution reserves the right to adjust prices to include any additional taxes or fees imposed by relevant authorities, as required by law. All applicable taxes will be added to the tuition total, itemized in the shopping cart and the confirmation email.
  • In some cases, corporate and/or group pricing is available. This pricing can be negotiated and administered by a representative of the Institution.

4.2 Payment Methods

  • Payment in full must be received at the time of registration. Access to the Site is granted once full payment is received. Accepted payment methods include Visa, MasterCard, or American Express.
  • Students are responsible for any transaction fees or charges imposed by their bank or payment provider when making a payment.

4.3  Payment Confirmation and Registration

  • After payment is accepted, a confirmation email will be sent to the Student with a receipt and registration details.
  • Registration in a course or program is only considered complete once the Institution successfully receives and confirms payment.

5. Access to the Site

  • The Student agrees to provide accurate and complete information during the registration process.
  • The Student agrees to maintain the confidentiality of their account credentials.
  • The Student’s access to the LMS is non-transferable and solely for their personal use.
  • The Institution reserves the right to suspend or terminate a Student’s access to the Site if any breach of this Agreement or misuse of the Site is detected.

6. Site Level Expectations

6.1 Limited Warranty

  • The Institution warrants that access to the Site will be available and functioning as intended. However, uninterrupted or error-free access to the Site is not guaranteed. This limited warranty is valid for the duration of your registration or access to the Site.

6.2 Disclaimer of Warranty

  • Except as expressly stated in the limited warranty above, the Institution disclaims all other warranties, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The Institution does not warrant that the Site will meet your specific requirements, or that it will be free from errors or other harmful components.
  • By accessing and using the Site, you acknowledge and agree that the Institution is not liable for any disruptions, damages, or losses that arise from your use or inability to use the Site. Students assume all responsibility for any risks associated with accessing and using the Site, including the accuracy, reliability, and usefulness of any information obtained through the Site.
  • Occasional downtime may occur due to scheduled or unscheduled maintenance, system upgrades, software updates or unforeseen circumstances. The Institution will make reasonable efforts to minimize disruptions and notify Students in advance whenever possible. If you cannot access the Site, please email cpe@ualberta.ca.

6.3 Technical and Student Support Services

  • The Institution will provide support for prospective and current Students seeking advice, guidance, registration assistance, or responses to non-technical questions by contacting cpe@ualberta.ca. Support is available during normal business hours 8:30 am - 4:00 pm Mountain Time, Monday - Friday (excluding statutory holidays).
  • Students that are having technical issues with their course can access 24/7 technical support via the Brightspace Support widget. Students can log a support ticket with Brightspace by D2L via this widget which is accessible in all areas of the LMS.

7. Withdrawals, Substitutions and Course Extensions

The following provisions apply to students registered for courses directly from the University of Alberta. If you are a partner registered student, please refer to their institutional policies.

7.1 Rick Hansen Foundation Inclusion and Accessibility Training

  • All course sales are considered final. Refunds will not be granted.
  • Course substitutions are not available.
  • Students have access to the course for 180 days. Course Extensions will not be granted.

7.2 Rick Hansen Foundation Accessibility Certification™ Fundamentals and Professional Training Course(s)

  • Students can withdraw up to 5 days prior to the course start date by completing the RHF Withdrawal Request form. All withdrawal requests must be approved and initiated by the Student.
  • Students will receive a refund of the course fee minus a $75 administrative fee. Withdrawal requests received after the deadline will not qualify for a refund.
  • In the event of a refund, the eligible amount will be issued to the original payment method used during registration, minus all administrative fees.
  • Students who do not formally withdraw from a course will be assigned a grade based on completed coursework.
  • Non-attendance does not constitute a withdrawal.
  • Course substitutions are not available.
  • Extensions will not be granted to access the site once the course has been completed.

8. Course Cancellations

  • The Institution reserves the right to cancel a course due to insufficient enrollment or unforeseen circumstances. In such cases, Students will be offered a full refund. The Institution will make every effort to inform Students of cancelled classes. Notices will be sent to the e-mail account the Student provided upon payment and registration. In the event of a refund, the eligible amount will be issued to the original payment method used during registration.

9. Course Requirements and Prerequisites

The following provisions apply to students registered for courses directly from the University of Alberta. If you are a partner registered student, please refer to their institutional policies.

9.1 Rick Hansen Foundation Inclusion and Accessibility Training and Rick Hansen Foundation Accessibility Certification™ Fundamentals Training Courses

  • No special requirements or prerequisites are required for students to complete this course.

9.2 Rick Hansen Foundation Accessibility Certification™ Professional Training

  • Course prerequisites are listed below and have been set by the Rick Hansen Foundation.
  • Students registering must meet the prerequisite requirements. By registering in courses, Students, by “honour-system”, agree that they meet these requirements. The Institution will not verify if prerequisites have been met.
  • Students who are unsure if they meet the prerequisite requirements in a course or who wish to obtain permission to have the prerequisite waived should contact cpe@ualberta.ca.
  • Refunds will not be granted to Students registered in a course if they have not satisfied the course prerequisites. Instructors have the authority to not pass a Student if they deem them unprepared to meet course requirements.

 Prerequisites for RHFAC Professional Training 

  • Students must meet one of the following requirements:
  1. A diploma or at least two years of completed post-secondary studies in architecture, engineering, urban planning, interior design or a related program; or
  2. A Journeyperson Certificate of Qualification in a designated trade related to building construction; or
  3. A minimum of five years of construction experience; or
  4. An equivalent combination of lived experience and built environment knowledge.
  • Education and credentials awarded outside of Canada will be considered.

10. Assessment and Grading

In courses where grades are assigned, unless stated otherwise, Students must follow the University of Alberta’s Assessment and Grading Policy. For Students who are registered in a Partner Institution’s course, their policies will apply.

10.1 Course Assessment

  • In Facilitated Sessions, participation is defined in each course outline. Students should familiarize themselves with the requirements for each course, as they may differ. This includes virtual attendance requirements. Students must check their availability before agreeing to register in a course.
  • Mandatory course components (e.g., quizzes, assignments, or discussion forum posts) must be completed by the stated due dates for Students to pass the course. The instructor will assign a zero to course components submitted late, without prior approval. A mark of zero on such a component may result in a failing grade being assigned. Students are strongly advised to read the course evaluation criteria detailed in the course outline.

10.2 Grade Appeals

  • The Institution has developed a set of procedures for Students who wish to appeal an academic decision relating to a final grade on a final project, or final examination received in a course or who wish to have a final examination or project reappraisal. These procedures apply to all Students.

11. Conduct and Integrity

  • Students are required to follow the Student Conduct Policy (for non-academic behaviour) and the Code of Student Behaviour (academic behaviour). These policies outline information on non-academic and academic offenses and disciplinary procedures respectively. Academic offenses include cheating and plagiarism.
  • At its sole discretion, the Institution reserves the right to unregister Students who violate Conduct and Integrity. In instances where Students feel they have been unfairly removed, they can contact cpe@ualberta.ca outlining these concerns within seven (7) business days of being removed.

12. Use of the Site

  • Students agree not to introduce into or through this Site any information or material that could potentially harm others. Among other things, Students agree not to include, knowingly or otherwise, any error or defect in information which may, among other things, constitute libel, slander, or defamation, or give rise to a criminal offence or civil liability on the part of any person or entity. Students guarantee that the information or material they provide electronically to the Institution through their access to or use of this Site does not infringe upon the rights of any individual or entity.
  • Students shall not: 
    • Disrupt or interfere with the functioning of this Site;
    • Impersonate any other person or entity or engage in any form of misrepresentation.
    • Upload, post, transmit, publish, or distribute any material or information for which they do not have all necessary rights;
    • Upload, post, transmit, publish or distribute any material or information which contains a computer virus or other code, files or programs intended in any manner to disrupt or interfere with the functioning of this Site;
    • Use this Site in such a manner as to gain unauthorized entry or access to the computer systems or networks of others or attempt to gain unauthorized entry or access to any password-protected or restricted areas of this Site;
    • Reproduce, copy, modify, sell, distribute or otherwise exploit for any commercial purposes any information, product, solution or service offered within this Site;
    • Violate any law or regulation, commonly accepted Internet practices, or interfering with the ability of other Students to use this Site and its provided services, solutions, or products;
    • Forge, alter, or modify in any way any of the agreements, policies, reports, or other information posted or accessible within this Site.
  • At its sole discretion, the Institution may terminate or refuse to permit the use of any products or services on this Site by any person or entity, for any reason and without notice.

13. Copyright

  • All intellectual property rights, including but not limited to course materials, content, and resources, provided by the Institution are protected by copyright laws. Students agree not to reproduce, distribute, modify, or use any course materials without prior written consent.
  • In providing hypertext links to Students, the Institution has not in fact authorized any other use of these materials that, if undertaken without permission of the applicable copyright owner(s) would constitute infringement of copyright. Permission for use of materials can only be granted by copyright owners or their assignees.

14. Links

  • Links from or to other websites or Internet resources outside the Site are meant for convenience only and are at the students own risk. The content, third parties named therein, opinions expressed, and other links provided by the Sites’ resources are not reviewed, investigated, verified, monitored, or endorsed by the Institution. The Institution makes no representations whatsoever about any other websites which Students may access through the Site, and shall not be responsible or liable for any damages in connection with links provided.
